involves cases where one party seeeks to argue that the issues involved concern the extent of gov. powers and/or the rights of citizens
precedents
prior cases whose principles are used by judges as the basis for their decisions in similar cases
stare decisis
"let the decision stand". doctrine that a previous decision by a court applies in similar cases until that decision is overruled.
